IHC declares Fawad arrest illegal, orders to release him

ISLAMABAD (Online): Islamabad High Court (IHC) while declaring PTI leader Fawad Chaudhry arrest illegal has ordered to release him.

The case came up for hearing before single bench of IHC led by Justice Miangul Hassan Aurangzeb Tuesday.

PTI leader was presented in the court.

Deputy Commissioner (DC) and Advocate General (AG) too appeared in the court.

The court remarked you had several methods to verify IHC order.

The court while moving to AG, Additional Attorney General (AAG) and DC Islamabad remarked we are giving you a little time. Think about a bit what happened.

Justice Miangul Hassan Aurangzeb remarked “ I have not even seen their contempt of court petition. I will ask my office to prepare file of contempt of court against him. The bail order issued by Chief Justice IHC was there. When a contempt of court case starts in my court then it does not stop. Therefore, we are giving time to think. Fawad Chaudhry will sit in the court room till you think.

The court remarked May 9 was not pleasant day. The apprehensions were correct. The petitioner should give affidavit after his release that he will not violate section 144. He should ensure it that he will not defy the law. If affidavit is violated then contempt of court will be initiated.

The counsel Babar Awan came on rostrum and said in his arguments Chief Justice IHC has ordered Fawad Chaudhry be not arrested. Law officers and media were present there when IHC issued orders. If it did not come to knowledge of deputy commissioner on May 8 but he had come to know about high court order later. Deputy commissioner has come to know about high court order now. Deputy commissioner should say now that he withdraws his order.

Justice Miangul Hassan remarked no he is not doing this.

Babar Awan said court should extend the order for stopping government from arresting Fawad Chaudhry. Fawad Chaudhry be given time to resort to respective court.

Justice Miangul Hassan Aurangzeb remarked was police shown any document regarding high court order for stopping the arrest of Fawad Chaudhry.

Babar Awan told when order was read out to him then police officer said he does not know English. The material of the apprehensions on the basis of which Fawad Chaudhry was arrested is not there.
