Shehryar Afridi case: We have taken oath to decide the cases as per law: Justice Babar Sattar

ISLAMABAD (Online): Justice Babar Sattar of Islamabad High Court (IHC) has remarked “ we have too taken oath that we have to make decisions as per law.

Who will compensate  those people who remained in jail, he gave these remarks during hearing of contempt of court cases against Deputy Commissioner (DC) , SSP operations and others on issuing MPO orders of Shehryar Afridi.

DC Rawalpindi and superintendent Adiala jail appeared in the court on court’s orders.

Justice Babar Sattar while expressing annoyance over DC Rawalpindi Hassan Waqar Cheema remarked as to why his order was not complied with.

DC Rawalpindi replied record keeper was on leave therefore, record could  not be provided.

Justice Babar Sattar remarked you should yourself have  brought record.  How can it happen that high court issues order and it is not implemented. Islamabad walas are facing. Do you want to face too.

Justice Babar Sattar remarked it  should be ensured court’s order is implemented. The high courts are sitting here for this purpose.

Advocate Qaisar Imam read out MPO record before the court.

Counsel for DC said during the hearing  copy of record which was presented by prosecutor is not with us.

The counsel for SSP said there is an objection from my side too which has to be put before the court.

Justice Babar Sattar remarked these technical things will not be in this court’s proceedings.

Counsel Shah Khawar said it is our request case be shifted to some other court.

He said the documents which were presented by prosecutor were not provided to us. These documents should have been provided to us before hand.

Counsel for SP city said it does not happen any where in the world that prosecutor  presents record of witness himself.

Justice Babar Sattar remarked this is not criminal trial. There is no private document therein. All the record is official.

He further remarked we will not go into technical matters. We will hear your objections.

Counsel Shah Khawar said we don’t want to file formal application in this regard. But it is our request.

Advocate Shah Khawar counsel for SSP Jamil Zafar made request for transferring the case to other court.

Justice Babar Sattar remarked it is a simple case. This is matter of rule of law. This case is not being referred to some other judge. Give the arguments. If his MPO orders were correct then decision will come. He has kept citizens of this country in jail for several days. Court’s  orders are there.

Shah Khawar counsel for SSP city said they  are discharging duty in difficult situation. There are several pressures on them.
