IHC rejects the plea for wrapping up the petition for recovery of poet Farhad

ISLAMABAD (Online): Islamabad High Court (IHC) while rejecting the plea by Additional Attorney General (AAG) for wrapping up the petition   regarding recovery of poet Ahmad Farhad adjourned the hearing till June 07.

Justice Mohsin Akhtar Kayani remarked, this case will come to end when he appears in the court.

The petition filed by Arooj Zainab wife of Ahmad Farhad came up for hearing before Justice Mohsin Akhtar of IHC Friday.

Counsel Iman Mazari and Hadi Ali Chatha advocate for the petitioner appeared in the court.

AAG Munawar Iqbal Dogal took the plea cases are registered against Ahmad Farhad in the jurisdiction of Azad Kashmir. He is on physical remand till June 02.

AAG requested meeting between Ahmad Farhad and his family has taken place. The habeas corpus petition be disposed of.

The counsel Iman Mazari said we had not only sought return but we had also sought that action be taken against those responsible for enforced disappearance.

Justice Mohsin Akhtar remarked this case will come to end when he appears in the court.

AAG argued Kashmir is foreign territory which has its own constitution and courts.

He further said the decisions of Pakistan courts are presented in the courts of Azad Kashmir as decisions of foreign court.

Counsel  Iman Mazari said family went to Dhir Kot police station from here. They saw the entire lock up and police station, Ahmad Farhad was not there.  On inquiring  it was told that he has been  transferred to Muzaffarabad under terrorism act.

Iman Mazari told the court when they reached there, the police said there is our case but he  is not in police station and is with SHO. Family went 14 kilometers away to meet Ahmad Shahzad . His plight was not good.

Justice Mohsin Akhtar Kayani remarked are there two FIRs against  Ahmad Farhad now.

AAG said two FIRs are in our knowledge.

Justice Mohsin Akhtar Kayani remarked arrest was made on May 29. We are exploring  the time prior to it that he was where.

Prosecutor General (PG)  Islamabad told Sit it will be seen by the court of Azad Kashmir.

Justice Mohsin Akhtar Kayani remarked every one should work within the parameters of law.

PG Islamabad took the stance they have done it within the parameters of law.

Counsel Iman Mazari argued the court has to see the misuse of law and process.

Justice Mohsin Akhtar Kayani said we have to determine the misuse  of law.

Justice Mohsin Akhtar Kayani inquired how many cases have been registered against Ahmad Farhad. Police will have registered 30 to 40 cases on protest. I will not offer comment now otherwise the number of cases will go up.

The court while rejecting the plea for wrapping up petition regarding  recovery of poet Ahmad Farhad adjourned the hearing of the case till June. 07.
